1. Acceptance of Terms

By accessing or using the RentSpace website, mobile application, or any of our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

RentSpace reserves the right to modify these terms at any time. Changes become effective immediately upon posting. Your continued use of our services constitutes acceptance of any modified terms.

2. Our Services

RentSpace provides a curated platform for:

• Property Listings: High-end rental properties across Nairobi's premier estates including Karen, Kilimani, Hurlingham, Syokimau, Ngong, and Kitengela.
• Relocation Services: Bespoke moving and transition services for residential and commercial clients.
• Sanctuary Preparation: Professional fumigation and deep cleaning services through our trusted partner network.
• Concierge Consultation: Personalized assistance for property viewings and residential transitions.

All services are provided with the highest standards of professionalism and discretion.

3. Property Listings

3.1 Accuracy of Information

While we strive to ensure all property listings are accurate and up-to-date, RentSpace does not guarantee the accuracy, completeness, or reliability of any listing information. Property details, including pricing, availability, and features, are provided by property owners and may change without notice.

3.2 Viewing Appointments

Property viewings are conducted by appointment only. RentSpace reserves the right to verify client identity and conduct background checks for high-value property viewings. A minimum of 24 hours' notice is required for viewing arrangements.

3.3 Rental Agreements

All rental agreements are between the property owner and the tenant. RentSpace acts as a facilitator and does not assume any responsibility for the terms, conditions, or execution of rental contracts.

4. Bookings & Payments

4.1 Holding Deposits

To secure a property viewing or reservation, a holding deposit may be required. This deposit is refundable in accordance with our cancellation policy. Details will be provided at the time of booking.

4.2 Payment Terms

All payments for relocation services or sanctuary preparation must be made in full prior to service delivery unless otherwise agreed in writing. We accept bank transfers and secure online payments.

4.3 Cancellation Policy

Cancellations made more than 48 hours before a scheduled service will receive a full refund. Cancellations within 48 hours may incur a 50% cancellation fee. Same-day cancellations are non-refundable.

5. Relocation Services

Our relocation services are designed to ensure a seamless transition for your property. By engaging our services, you agree to:

• Provide accurate information about the volume and nature of items to be moved.
• Ensure all valuable items are declared prior to the move.
• Secure necessary permits for parking and access at both origin and destination locations.
• Be present or designate a representative during the move.

6. Privacy & Data Protection

RentSpace is committed to protecting your privacy. We collect and process personal information in accordance with our Privacy Policy and applicable data protection laws, including the Kenya Data Protection Act, 2019.

Your information is used solely to facilitate our services and will never be shared with third parties without your explicit consent, except as required by law.

7. Limitation of Liability

To the maximum extent permitted by law, RentSpace shall not be liable for:

• Any indirect, incidental, or consequential damages arising from your use of our services.
• Losses resulting from property transactions between landlords and tenants.
• Damage to property during relocation where proper documentation was not provided.
• Third-party services recommended but not directly provided by RentSpace.

Our total liability for any claim shall not exceed the amount paid for the specific service giving rise to the claim.

8. Termination of Services

RentSpace reserves the right to suspend or terminate services to any client who:

• Violates these Terms of Service.
• Provides false or misleading information.
• Engages in fraudulent or abusive behavior.
• Fails to make payments as agreed.

Upon termination, any outstanding fees remain payable and deposits may be forfeited.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
